Diebold “whistleblower” faces criminal charges in California

Los Angeles County prosecutors have brought three felony charges against Stephen Heller for stealing documents from his employer, the law firm Jones Day.

The legal documents discussed the legal ramifications of activist allegations that Diebold Election Systems had used uncertified voting systems in Alameda County elections beginning in 2002. Jones Day represented the controversial electronic voting machine manufacturer at the time. The firm’s lawyers concluded that if such uncertified systems were used, then Diebold could be sued by Alameda County for millions of dollars. The memos also discussed whether the California’s secretary of state had the authority to investigate Diebold.

Mr. Heller has been charged with felony access to computer data, commercial burglary and receiving stolen property. He has pled not guilty.

Blair Berk, Heller’s attorney said, “It’s a devastating allegation for a whistle-blower. Certainly, someone who saw those documents could have reasonably believed that thousands of voters were going to be potentially disenfranchised in upcoming elections.”

Stress affects health in many ways, unfortunately none of them affects well-being in a good way. Many health specialists claim, as normal human experience would confirm, that stress and depression can have negative effects on physical health. In the long run, persons under high stress can develop eating disorders and sleep disturbances. These conditions could also possibly lead to decreased physical energy, chronic pain, and sexual dysfunction.

Physical illnesses are almost always present whenever a person is under extremely stressful conditions. Even the body’s internal processes respond to external difficulties experienced by a person. During stressful situations, the adrenal glands inside the body release a substance called cortisol. Cortisol is a natural steroid hormone that science experts refer to as the stress hormone. It is known as thestress hormone because large amounts of this substance are released whenever a person feels stressed out. It is an important hormone in the human body because it is involved in proper glucose metabolism, regulation of blood pressure, and control of immune system functions, and inflammatory response.

In general, cortisol is present in the body at elevated levels in the morning and lowest in the evening. Small increases of cortisol have some positive effects like quick bursts of energy, improved immunity, heightened memory function, and lower sensitivity to pain. In addition, moderate doses of cortisol helps maintain homeostasis in the body. Homeostasis is the property of living organisms that regulates its internal environment to maintain a stable and constant state in terms of body temperature, acidity, and nutrient and waste balance. Health experts stress that this process is critical for survival and good health. With minimal or no thought at all, people maintain and restore homeostasis all the time. For example, people drink if they are thirsty, wear a sweater when it is cold, or take a rest after an intense physical activity. All these actions contribute to ones state of homeostasis. Dilemmas occur when the body’s cells fail to communicate properly, and cause breakdown in homeostasis. This disturbance can lead to poor health and later into serious health conditions.

Sustained and prolonged levels of cortisol, however, may lead to many harmful effects like high cholesterol, suppression of the immune system, and acceleration of the aging process. Prolonged stress may lead to imbalance of cortisol in the body which causes disturbance in the components of the digestive, cardiovascular, respiratory, and other major systems of the body. Medical specialists conclude that such imbalance may lead to several illness like cancer, heart disease, and Alzheimer’s disease. In addition to these harmful effects, high levels of cortisol may lead to weight gain. When people become stressed, the adrenal glands produce more cortisol that release sugar in the blood which then leads to additional weight gain. Studies add that people who secrete higher levels of cortisol as a reaction to stress tend to eat more food that is high in carbohydrates. To keep cortisol levels under control, the body’s relaxation response is activated during stressful situations. The following methods have been proven by many health experts to be very beneficial helping the mind and the body relax and, in the process, control the body’s production of cortisol:

Journaling or keeping a diary

Self-hypnosis

Exercise

Yoga

Listening to music

Meditation

Sex

Cortisol production varies from person to person. People are biologically designed to react differently to different forms and intensities of stress. There are many kinds of medication out in the market that are designed to reduce high levels of cortisol in the body. However, it is important to understand that certain illnesses are caused by too much stress. Keeping our lives as stress-free as possible and by practicing stress management techniques, living life would not be so hard as it seems.

Emergency at JDS Uniphase in San Jose, CA

The San Jose, California fire department and Hazardous Materials crews today responded to a chemical emergency at a JDS Uniphase manufacturing facility. The incident, at 80 Rose Orchard Drive, off North First St., sent between 15 and 17 people, including two firefighters, to the hospital with symptoms and for observation.

Those exposed to the hazard reported a smell of “burnt rubber”, along with symptoms of eye and throat irritation.

Over 48 others were held in a nearby building while the incident was assessed. Rose Orchard Way was closed for much of the day while emergency crews responded. Estimates put the incident at about 10 a.m. (1800 UTC).

As of 6 p.m. television news reports, authorities still had not determined the source or nature of the chemical, but said neighboring buildings were not in danger.

JDS Uniphase manufactures fiber optic communications and test equipment, and was formed from a merger of JDS FITEL and Uniphase Corporation in 1999.

International exhibit of chair art starts in Canada

The international entry mail art show SAT: An Exhibit of Chairs was put on display Friday in Brampton, Ontario, Canada. Held in the Fridge Front Gallery at the Shoppers World Brampton mall, SAT is a diverse collection of artworks focusing on a generally mundane object, the chair.

Works in the show range from realism to abstract, dadaism to surrealism, post-modern to collage.

While some of the entries were submitted directly to Visual Arts Brampton, most came from a previous exhibit. Organized by Pati Bristow, No place to rest, chairs you can’t sit on ran at Shopping Trolley Gallery West and Seaman’s Library at Foothill College, both in Los Altos Hills, California, earlier in 2005. Guest curator Nicholas Moreau was unaware of the similarly themed exhibit, held so soon before. The theme for SAT was based on that of a 1987 juried art show organized by Visual Arts Brampton at the now-defunct Chinguacousy Library Gallery.

Works in Visual Arts Brampton’s showing of the exhibition are from 17 countries including Belgium, Brazil, Canada, Finland, France, Germany, Ireland, Italy, Japan, Netherlands, Norway, Pakistan, Romania, Spain, Uruguay, the United Kingdom, and the United States of America.

This is Visual Arts Brampton’s third mail art show. In 1999, Susan Williamson created The Great Canadian Mail Art Show for Artway at Bramalea City Centre; the show was so successful that the Art Gallery of Peel adopted it in 2001. The concept of a mail art show was revived in 2004 by Moreau, held at the new Artway Shoppers World. The Snail Mail World Postcard Art Show has been held annually since.

Visual Arts Brampton’s Fridge Front Gallery primarily hosts artwork by youth from its kids classes, and from schools in Brampton and Oakville. In contrast, the nearby Artway Gallery hosts artwork by professional and amateur adult artists from across Peel. VAB has successfully sought permission to create a third display space in Shoppers World, in the Zellers corridor. The space will host shows of mail art and works on paper year-round. The planned “World Art Gallery” will be the first ever permanent display space for mail art.

Former Illinois Governor Blagojevich rests in corruption trial

Despite promises he would testify in his own corruption trial, lawyers for former Illinois Governor Rod Blagojevich rested their case yesterday morning. His defense did not call a single witness, and apparently feels the prosecution has not proven their case. Closing arguments are scheduled for Monday.

Speculation that Blagojevich would not testify began on Tuesday, when U.S. District Judge James Zagel adjourned 90 minutes early after a private meeting with the lawyers involved. Robert Blagojevich, the former governor’s brother and co-defendant in the case, had already testified on his own behalf. Blagojevich’s defense team apparently considered resting their case on Tuesday, but Zagel gave them an extra day to consider their decision more carefully.

When Zagel directly asked the former governor about his decision, he replied that he understood what he was doing. “It is my decision, under the advice of my attorneys. I make the decision fully and voluntarily,” he said.

Blagojevich is charged with trying to sell the U.S. Senate seat that had been vacated by Barack Obama when he won the 2008 presidential election, among other crimes. Robert Blagojevich testified that his brother was trying to manipulate the political situation to his advantage, but emphasized that he engaged in nothing illegal. According to some sources, Blagojevich was interested in leading the U.S. Department of Health and Human Services.

Blair launches third and final manifesto

Tony Blair today launched the Labour Party’s 112 page manifesto for a third term, entitled “Britain: Forward not back”, at London’s Mermaid Theatre this afternoon, promising not to increase income tax or VAT.

Blair, with Chancellor Gordon Brown, described the manifesto, which focused on economic policy, as “radical”, “quintessentially New Labour” and giving people the “chance to succeed and make the most of what they have”.

As well as economic promises, the manifesto pledged better social housing, increased funding and reform of education and the National Health Service and the introduction of community police patrols. The manifesto does not promise a freeze on National Insurance, the income-linked tax which funds the NHS and pensions.

Conservative leader Michael Howard said that the British people had “heard it all before”, and reiterated claims that Labour would have to increase taxes significantly in the third term.

Deputy leader of the Liberal Democrats, Sir Menzies Campbell, whose party was the only mainstream party consistently against the Iraq war, said Labour would “not be judged by their promises, but by what they have done”, adding that Labour have not kept their previous promises.

The Conservative Party and Green Party launched their manifestos yesterday, and the Liberal Democrats launch theirs tomorrow.

Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.

Nintendo releases GameBoy Micro in the US

On the 20th birthday of Nintendo‘s mascots, Mario and his brother Luigi, Nintendo has released the newest addition to the popular Game Boy line.

The Game Boy Micro is the smallest handheld release by Nintendo to date. Unlike other handhelds in the Game Boy Advance series, the Game Boy Micro can only play Game Boy Advance games and not games designed for the original Game Boy system. The handheld features a new link port, includes multiple removable faceplates, and additional faceplates can be purchased separately. This system has an MSRP of USD$99.99.
